General Terms and Conditions of the Online Shop of the Museums of Kunstsammlungen Chemnitz
Kunstsammlungen Chemnitz, which includes the following museums: Kunstsammlungen am Theaterplatz, Museum Gunzenhauser, Schloßbergmuseum, Burg Rabenstein, Henry van de Velde Museum in the Villa Esche and Karl Schmidt-Rottluff Haus, is a public corporation of the City of Chemnitz with legal capacity. The museums are represented by the General Director of Kunstsammlungen Chemnitz, Dr Florence Thurmes.
1. Scope
These General Terms and Conditions (GTC) apply for all orders for goods and services placed via the online shop of the museums of Kunstsammlungen Chemnitz. Deviating terms and conditions will only be recognised if Kunstsammlungen Chemnitz/City of Chemnitz has agreed to them in writing prior to conclusion of the contract. The GTC valid at the time of the customer's order shall apply. The contractual partners for orders placed via the online shop are Kunstsammlungen Chemnitz/City of Chemnitz.
The tickets are sold exclusively to end customers. There is no entitlement to the service provided for in the ticket if the ticket was purchased via a third party. Kunstsammlungen Chemnitz/City of Chemnitz reserve the right to limit the number of tickets per customer. Prior sale is not permitted.
2. Formation of the contract
The order or purchase of admission tickets in the online shop establishes a contract exclusively between the customer and Kunstsammlungen Chemnitz/City of Chemnitz. In the ticket shop, customers can purchase admission tickets for the exhibition area of a museum for a specific date and period. The customer is invited to select a period/date and one or more ticket categories. By adding the tickets to the shopping basket, entering their personal and payment details and confirming with the "CONFIRM ORDER" button, the customer submits a binding offer to conclude a contract. The order process can be changed or cancelled at any time until the order is sent. An order can only be sent if the customer has ticked the boxes “Yes, I have read and agree to the terms and conditions” and “Yes, I have read and agree to the privacy policy”.
A contract is formed when the customer receives a written order confirmation from Kunstsammlungen Chemnitz/City of Chemnitz. This can also be sent electronically to the e-mail address provided by the customer. Alternatively, the contract is formed when the invoice is sent to the customer or the ticket is delivered. It is not possible to change the ticket category, the day of the visit, the time of the visit or the duration of the visit.
3. Cancellation
In accordance with section 312g(2) no. 9 of the German Civil Code (BGB) in conjunction with section 355 BGB, no right of cancellation, exchange or return applies to the sale of tickets with a fixed validity date or fixed period. An order for such tickets is binding upon receipt of confirmation by Kunstsammlungen Chemnitz/City of Chemnitz and is subject to payment. Refunds are not possible, even in cases of force majeure or changes in the personal circumstances of the customer.
4. Prices
The admission charges for the museums of Kunstsammlungen Chemnitz/City of Chemnitz are exempt from VAT in accordance with section 4 no. 20a of the German VAT Act (UStG). The total price of the order is due for payment upon conclusion of the contract. Proof of concessions must be presented to the museum staff together with a valid identity document. If no such proof is provided, Kunstsammlungen Chemnitz/City of Chemnitz may demand the difference from the normal price or confiscate the ticket without refund and refuse admission.
5. Products
Tickets for a museum can be purchased in the ticket shop for a specific date or period. After the booked time slot has expired, Kunstsammlungen Chemnitz/City of Chemnitz reserves the right to ask visitors to leave the exhibition area if it is overcrowded. Children under the age of 14 must be accompanied by an adult. The customer is responsible for arriving at the entrance to the museum at the booked time. In the event of late arrival, there is no entitlement to admission, rebooking or a refund.
The ticket shop only offers free Print@Home dispatch as a PDF document, which will be sent to the e-mail address provided by the customer. If the ticket is not delivered within 24 hours of booking or if there are problems with printing, the customer must inform Kunstsammlungen Chemnitz/City of Chemnitz immediately. If no such notification is given, claims based on loss of ticket are excluded. The customer may not reproduce, duplicate or modify the ticket. An admission ticket that is duplicated or resold without authorisation does not entitle the holder to enter the museum. The barcode on the admission ticket is only valid once and is electronically invalidated on site.
Alternatively, the ticket can also be used on a smartphone, provided it is technically functional and readable.
6. Payment
The following payment methods are accepted: credit card (VISA and MasterCard) and PayPal. The customer transmits their credit card details with the order. Once the customer has been identified as the legitimate cardholder, the payment transaction will be carried out by the credit card company.
7. Liability
Kunstsammlungen Chemnitz/City of Chemnitz will only be liable for damage caused by intent or gross negligence on the part of its employees, authorised representatives or the visitor service. This is without prejudice to liability for damage to life, limb or health. Kunstsammlungen Chemnitz/City of Chemnitz accept no liability for interruptions or errors in the online shop or on the website.
8. Data protection
The current version of the online shop’s privacy statement applies.
9. Final clauses
The exclusive place of jurisdiction for all disputes in connection with these GTC is Chemnitz. German law shall apply. Any amendments to these GTC must be made in written form. The English translation of these GTC is for information purposes only and is not part of the contract.
These GTC will come into force from the date of publication of the online shop.
